This article provides a new interpretation of Hannah Arendt’s critical analysis of the ‘perplexities of the Rights of Man’ by drawing attention to its overlooked methodological orientations, especially its ‘aporetic’ nature. Arendt’s critique is aporetic as it centres on the paradoxes of human rights and analyses them by putting into practice a mode of inquiry that she associates with Socrates. The article challenges the conventional understanding of aporia as a paralysing impasse and suggests that aporetic thinking can create possibilities of (...) rethinking key concepts especially in times of crises. To make this point, I respond to Jacques Rancière’s criticism that the paradoxes introduced by Arendt paralyse thinking and doom human rights to an inevitable destiny of failure. I argue that, precisely because of its aporetic nature, Arendt’s critique attends to possibilities of rethinking and reinventing human rights, as can be seen in her articulation of ‘a right to have rights’. Bir ve üçüncü ayette tekrar eden bu oku emri, açık bir okuma ve öğrenme vurgusu olarak sunulmaktadır. Dördüncü ayetteki “kalem” ifadesi okumanın yanında yazmayı da sürecin bir parçası olarak takdim eder. “Rabb” ile “terbiye” arasındaki ilişki de yine eğitimin etimolojisi ve tanımı söz konusu olduğunda ilk vahiy bağlamında öne çıkartılan hususlar arasındadır. On December 7,1999, a divided Oklahoma Supreme Court held in Nealis v. Baird that a claim may be brought under Oklahoma's wrongful death statute on behalf of a nonviable fetus born alive. The decision represents a departure from the traditional notion that “viability”—the ability of a fetus to sustain life outside the womb with or without medical assistance—is the standard for wrongful death recovery. In replacing the “viability” standard with a “live birth” standard, the majority maintained that live birth is (...) the “unassailable point at which legal rights must be said to attach to the human person. “ By holding a nonviable fetus a legal “person” for the purpose of a wrongful death claim, the court's decision emphasizes the limited application of the United States Supreme Court's holding in Roe v. Marx’s concept of value has been subject to significant criticism. Robinson argues that the concept is awkward and obscure, as it is meant to explain the prices of commodities and thus must be a kind of price, but it is not. Consequently, Robinson holds that the concept of value makes no sense. Furthermore, according to Harvey, Marx in the _Grundrisse _confuses value with price. It seems to me that both Robinson’s criticism and Harvey’s exegesis are based on serious misunderstandings. In (...) this article, I first unpack Marx’s criticism of Darimon’s proposal concerning time chits. The upshot is that, for Marx, production relations enjoy a priority, and a monetary reform like Darimon’s cannot fulfill the function of revolutionary change. So, time chits become a triviality. Second, I suggest a reconstruction of what I call Marx’s “nonconvergency thesis.” The thesis states that there is a supervenience between value and price. Marx says that Darimon is ignorant about this thesis, and his proposal relies on the delusion that the two are convergent. Therefore, I maintain that Harvey’s claim is misleading, as he overlooks the nonconvergency thesis articulated in the _Grundrisse_. And Robinson’s condemnation of the concept of value should be dismissed because her understanding is very much the same as Darimon’s, in that she ignores the two-layered ontological structure between value and price. Giorgio Agamben presents us with one of the most powerful and controversial criticisms of human rights. He contests conventional understandings of human rights as normative setbacks on sovereign power, and shows instead how these rights reinforce sovereignty by producing bare lives that are irredeemably exposed to violence. This essay aims to understand the distinctive aspects of Agamben's critique and assess his concluding call for a politics beyond human rights. It suggests that this call is necessitated by a counternarrative of Western (...) politics that ties human rights inextricably to the logic Agamben ascribes to biopolitical sovereignty. Within this stringent logic, any politics organized around human rights cannot help but reproduce sovereign violence. The essay questions this counternarrative in two ways: First, it shows how this counternarrative, which aims to unveil all the myths that sustain sovereignty, ends up repeating what it identifies as the distinctive mythologizing gesture: rendering the contingent necessary. Second, it turns to Agamben's notion of ‘potentiality’ to break the binding spell of his narrative of fated necessity and reclaim the contingent, equivocal and unpredictable effects of modern rights declarations and struggles. The essay concludes with a discussion of contemporary rights struggles of sans-papiers to illustrate the strengths and limits of Agamben's critique of human rights. (shrink)

In confrontation with the current events of his time, Max Scheler develops his idea of a “new Europe”, which is to emerge from the ruins of the First World War in confrontation with “capitalist England” and through the awakening of a new religiosity. From the 1920s onwards, the idea of unity under Catholicism is overcome and raised to a higher level to a global and cosmopolitan level. Scheler speaks of a “cosmopolitanism” that needs to be learned and will ultimately entail (...) a balancing process (Ausgleichsgeschehen). Scheler understands this Ausgleich and cosmopolitanism as an educational task (Bildungsaufgabe). According to Scheler, only in and through the education (Bildung) of persons towards this idea can national, cultural and religious one-sidedness be overcome. Scheler's new conception of knowledge and Bildung plays an essential role in this, culminating in the concept of the all-man (Allmensch), who, as a relative all-man, is to be both a model and a goal. The aim of the present study is to evaluate Sonja Foss’s Rhetorical Schema for the Evaluation of Visual Imagery as well as reflect upon several points for further consideration; and finally suggest a renewed triadic approach as a method for analyzing art-relevant visual imagery. The triadic approach to be discussed assumes three correlative layers: the intellectual knowledge, function of the artistic content as the visual representational component, and aesthetics as modality. This study will include the analysis of a print advertisement (...) that used an artwork as its content of visual rhetoric, and this will inform further discussions on the proposed approach. The contribution of this renewed triadic approached to the field of visual rhetoric has the advantage of expanding and possibly improving rhetorical analysis methods of visual imagery. (shrink)

This article aims to examine the racialized forms of violence enacted by contemporary border regimes by rethinking border deaths as “forced disappearances." Although “forced disappearance” is often associated with military dictatorships, I extend it to border control policies that push migrants beyond the pale of the law, make it difficult to find out about their fates or whereabouts, and render their lives disposable. In thinking about border deaths as forced disappearances, I move beyond the strictly juridical meaning of this term (...) and foreground its phenomenological resonances to inquire into the conditions of appearance and disappearance, including the social structures, normative orders, and representational frameworks that make and unmake one’s relations to the world and other living beings. To undertake such an inquiry, I engage with Frantz Fanon's works and examine how borders establish racialized partitions among both the living and the dead. The analysis highlights how certain elements of colonialism—spatial compartmentalization, racial immobilization, routinized violence, legalized lawlessness—reappear within border governance. It also points to the crucial role that law plays in legitimizing racialized state violence in border control. (shrink)

Mâzerî et-Temimî (ö. 536/1141) Endülüs’ün düşmesinden önce Kuzey Afrika’da yaşamış son fakihlerdendir. Malikî fıkhının usûl-i fıkıh yapısının oluşumunda önemli dönüm noktası olarak kabul edilen Îzâhu’l-Mahsûl min Burhâni’l-usûl isimli eserin müellifidir. Hadis, fıkıh, kelam, tıp ve fetvâ alanlarında kayda değer bilgi sahibi Mâzerî’nin usûlcülüğüne dair bir çalışmanın yapılmamış olması bu çalışmayı gerekli kılmıştır. Çalışmada Mâzerî’nin usûl anlayışı usûl-i fıkıh alanında yazdığı Îzâhu’l-Mahsûl isimli eser üzerinden incelenmektedir. Îzâhu’l-Mahsûl, Mâzerî’nin Şâfiî âlim İmâmü’l-Haremeyn Cüveynî’nin (ö. 478/1085) el-Burhan fî usûli’l-fıkh isimli usûl-i fıkıh eseri üzerine (...) yapılan bir şerhtir. Şerhedilen Cüveynî’nin el-Burhân isimli eseri, Şâfiî usûl-i fıkhının temel metinlerinden birisidir. Mâzerî bu önemli eser üzerine yaptığı şerhte, hocası Cüveynî’nin konu tasnifi ve sistematiğini takip etmiş, usûl-i fıkıh yazımında mütekellimin yöntemini uygulamıştır. Hocasının eseri ile benzerlikler taşımasına rağmen söz konusu şerh, tamamlanmamış hâliyle dahi yer verdiği görüşler ve değerlendirmeler ile müstakil bir eser mahiyetindedir. Mâzerî eserde hocasına muhalefet etmekten çekinmemiş, kendi ictihad usûlünü ortaya koymuştur. Araştırmaya inceleme konusu edilen Îzâhu’l-Mahsûl isimli eser, Şâfiî usûl-i fıkhının Malikî usûl-i fıkhını yöntem ve içerik açısından etkilemesi açısından önemli bir örnektir. Bu eser ile birlikte Mâlikî usûl-i fıkıh literatürü ve metinleri Îzâhu’l-Mahsûl’den örnek alınarak oluşturulmuştur. Mâzerî sonrası Malikî usûlcülere kaynak olan bu eser, aynı zamanda Şâfiî-Malikî usûl-i fıkıh etkileşiminin izlerini barındırdığı için inceleme konusu edilmiştir. Çalışma kapsamında Îzâhu’l-Mahsûl eserinde Mâzerî’nin usûl anlayışında öne çıkan ilkeler tespit edilmeye çalışılmıştır. Böylece Mâlikî usûl-i fıkhının hangi hususlar üzerine inşa edildiğinin net olarak ortaya konulması hedeflenmiştir. Mâzerî’nin usûl anlayışının içinde yetiştiği fikri ve siyasi ortamdan etkilenmemesi mümkün değildir. Bu durum göz önünde bulundurularak Mâzerî’nin hayatına, hocalarına, eserlerine ve yaşadığı dönemde Mağrib bölgesinin düşünsel ve siyasi atmosferine kısaca temas edilmeye çalışılmıştır. Yaşamına dair tüm detayların, Mâzerî’nin ilmî hayatına ve özelde usûlcülüğüne etkisi anlaşılmaya çalışılmıştır. Ayrıca Mazerî’nin usûl anlayışının öne çıkan unsurlarının tespiti, Mağrip bölgesindeki fıkhî yapının anlaşılması ve İslâm hukuk tarihi açısından bölgenin aydınlatılması açısından da önemlidir. Söz konusu saiklerle yapılan çalışma, Mâzerî’nin usûl anlayışını temel özellikleri açısından ortaya koymayı amaçlamaktadır. Böylece Mâzerî’nin Mâlikî usûl-i fıkıh anlayışına ve literatürüne yaptığı katkıya ışık tutmak amaçlanmıştır. Araştırmada nitel araştırma metotlarından doküman incelemesi yöntemi kullanılmıştır. Bu bağlamda Mâzerî’nin görüşleri, kendisinden etkilendiği hocası Cüveynî’nin görüşleri ile mukayese edilmek suretiyle metin analizi uygulanmaya çalışılmıştır. (shrink)

In the present study, we tried to deal with the controversial concept of Alevism. Over the years, it has drawn our attention that controversial concepts have increased remarkably in various articles and studies. Especially heterodoxy, orthodoxy, syncretism, etc. It has been seen that the main concepts come to the fore as the main discussion axis in Alevism studies. However, without knowing what these concepts are, Alevism is being dragged into completely different channels with the tendency of slogans such as "Alevism (...) is heterodoxy, Alawism is syncretism". From this point of view, the need to deal with controversial concepts that create the hidden agenda has emerged. From this point of view, we tried to deal with the main platform concepts and discussions encountered in Alevism studies. In particular, we tried to deal with the controversial concepts formed around the speculations produced by the West and that create the hidden agenda. The Ottoman Safavid rivalry attracted the attention of Europe which sought to expand its research and experience in the field. To date, incomparable literature has been produced in this field. Over time, this literature has become a reference source for modern Alevism studies. Although these studies are partially objective, the ambassadors, clerics, travelers, and researchers who wrote them could not escape the influence of the educational, cultural, and religious political perspective from which they came. This accumulation, which was transferred to the present over time, was transmitted to other generations and formed a tradition of perception. Alevism, which was condemned to vicious circles such as sectarianism, left-wing radicalism, etc., was included in the script of studies that aimed at politicization, marginalization, and conceptual distortions by separating it from the religion of Islam. But at the same time, the changes in knowledge and methods produced by each period were reflected in this literature. In this context, the research products on Alevism have formed the information infrastructure in politicization and orientation activities. This long-standing interest of the Europeans eventually allowed the emergence of new concepts and some evaluations from their own perspectives. Due to the lack of systematic theology of Alevism and its structure as a mythological theological understanding based on oral literature and traditions, no consensus could be reached on the definition. As a natural result of this, Alevism operates with the belief that it is in a race to be defined by different people and groups, and each one of them is the right one. Thus, Alevism is an emotional state where everyone can speak and even feel themselves in absolute truth. As a method, we tried to examine the leading controversial concepts with their current counterparts in a concrete way, so that they can find concrete answers in the minds of researchers. In addition, we have tried to deal with the works that set the agenda in the past and today. Thus, it will reflect the general view of the controversial concepts of Alevism. This situation of Alevism has attracted the attention of orientalist researchers (George White, Irène Mélikoff, Marcus Dressler, Hans Lucas Kieser) in the historical process, and they have shown interest in this field with political, ideological, religious, and other motives. While doing this, they preferred to use the concepts found in the history of Christianity and Judaism in the field of Alevism. These researchers have used the historical understanding and patterns of their cultures, such as Christianity and Judaism, to which they originally belonged, in interpreting Alevism. All these approaches prevent the correct perception of Alevism and lead to an environment of mental confusion and chaos. It has caused Alevism to move away from the scientific understanding it deserves. (shrink)

Geçmişte İngilizler ilk dönemlerinden itibaren İslamiyet hususunda bilgi birikimleri üst seviyelere ulaştığı halde, Şiîlik çalışmaları işin içine dâhil olduğunda daha geç tarihlere rast gelmiştir. İngilizlerin Şiilik alanında çalışmalarının hayata geçmesiyle ilginç hususiyetler kendini göstermiştir. Bilgi-siyaset, siyaset-bilgi denklemleri İngilizlerin Orta Doğu coğrafyasındaki etki ve icraatlarında değişmeyen hareket noktası olmuştur. Safevîler döneminden başlayarak, Dünya savaşları sürecinde saha hâkimiyetlerinin arka planında yüksek bilgi birikimi kendini göstermiştir. Ortadoğu bugün bile bu etkiden hala kurtulamamıştır. Çalışmamızın ana ekseni olan (...) İngiliz erken dönem Şiilik çalışmalarının genelinde göze çarpan hususları arz ettikten sonra bu alanda zirveye noktaya ulaşmış İngiliz Araştırmacı Thomas Herbert’i incelemeye çalıştık. Herbert, dönemin Şia düşüncesini, sokakta yaşayan hayatını ve bizzat kendi gözlemlerinden aktarması bakımından oldukça benzersizdir. Zusammenfasung: In diesem Artikel fokussiere ich auf die Kluft zwischen dem Begriff des „Menschen“, der den Menschenrechten zugrunde liegt, und dem Konzept der universellen Rechtspersönlichkeit, das ich im Hinblick auf die mediterranen Flüchtlingsbewegungen untersuche. In Anlehnung an Arendts berühmtes Diktum vom „Recht, Rechte zu haben“ analysiere ich die Spannung zwischen den souveränen Rechten von Staaten und den Rechtsansprüchen von Migrant*innen, was wiederum auf das hinweist, was ich als „Grenzen der Menschenrechte“ bezeichne: Sie beziehen sich auf die Begrenztheit der Menschenrechte angesichts (...) der staatlichen Souveränität und sind in der Grenzkontrollpolitik der einzelnen Staaten und ihrer Grenzbehörden verkörpert. Wie ich unter Bezugnahme auf den Fall Hirsi vorschlage, sollte die Rechtspersönlichkeit von Migrant*innen jenseits territorialer Grenzen gedacht werden, während staatliche Funktionen, wie die Kontrolle der Staatsgrenzen, im Lichte der Menschenrechtsnormen überdacht werden müssen. Şüphesiz düşünce dünyasına adım atma cesaretini gösteren insanı meşgul eden sorulardan biri de kendisinin nasıl bir varlık olduğudur. Varlığını keşfetme sürecinde felsefe, antropoloji, psikoloji ve biyoloji gibi bilimlerin insana ilişkin ortaya koymuş oldukları anlayışlar yol gösterici olsa da insanın özünü keşfetme noktasında yetersiz gelebilir. Zira gelişen ve değişen bir varlık olarak insan yaşadığı toplum, kültür ve tarihsel arka planından tecrit edilerek bir tanıma hapsedilmesi varlığının keşfedilmesi yönündeki en büyük engeldir. Benzer bir düşünceden hareketle Heidegger insanın özünü animal rationale olarak belirleyen (...) metafiziksel anlayışı insanın aslına ulaşamadığı gerekçesiyle eleştirmektedir. Hatta Heidegger’e göre bu anlayışla insan özünü kavrayamadığı gibi kendi özünden de uzaklaşmıştır. Modern öznenin temellerini atan bu anlayış insanın her şeyi nesneleştirmesi ve kendisini yeryüzünün efendisi gibi görmesine neden olmuştur. Oysa gerçekte insanın göz kamaştıran gücünün sınırsız genişlemesine aracılık eden teknoloji Heidegger’e göre büyük bir tehlikedir. Çünkü insan kendisini her şeye hâkim olarak tecrübe ettikçe teknolojinin egemenliği altına girdiğini fark etmeksizin özünden uzaklaşıp kaynağa dönüşmektedir. Buradan hareketle Heidegger Hölderlin’in “Ama tehlikenin olduğu yerde, kurtarıcı da büyür” dizesi ile teknolojinin en büyük tehlikenin kaynağı düşünme ve şiirin ise kurtarıcı olduğunu ifade eder. Ancak teknolojinin tehlike olarak mı kalacağı yoksa yerini kurtarıcıya mı bırakacağı insanın teknoloji ile kuracağı ilişkiye bağlıdır. (shrink)

The purpose of this study was to explain differences between employees who feel a sense of belonging and those who feel a sense of otherness in terms of their opinions about diversity works in their organizations. We conducted an empirical study to examine the perceptual differences between two independent groups of the study “who feel a sense of belonging” and “who feel a sense of otherness.” We collected data from 792 employees working for organizations in different sizes, industries, and capital (...) structures, which enriched the representativeness of the sample. The findings show that out-group members remain less satisfied with diversity works in their organizations based on four main issues such as “competence of diversity actors,” “embeddedness of diversity works in organizational policies/practices,” “diversity awareness in the HRM functions,” and “diversity-related employee satisfaction.” This paper makes two contributions. First, it contributes to the extant literature an understanding of the differences between those who remain indifferent to diversity works and those who care to see, speak, and hear about them. Second, with a few exceptions, extant studies on diversity works have been dominated by Western-centered research. Research is needed on countries with different macro-contextual conditions, such as different legal regulations, socio-political status, and history. For this study, survey data were collected from people who work in Turkey, a country which has limited legal measures and underdeveloped discourses for equality, diversity, and inclusion. The paper provides significant insights into leading diversity works in national settings with less developed supportive mechanisms for diversity. (shrink)

To study the commentaries of Nuniyya inclusively wouldhelp to understand Ottoman kalam thought. The commentaries written in OttomanTurkish and Arabic on Nuniyye, especially the commentary of Hayali andthe commentaries on Hayali's commentary, has an incomparable importance toinvestigate Ottoman kalam thought which has continued for five centuries. Oneof these commentaries is al-Cawahir al-Kalamiyya which has been wrote inArabic by Lalazari who is (...) known as Sufi scholar. This article aims to find outthe importance of al-Cawahir al-Kalamiyya in Ottoman kalam tradition, toenhance knowledge about the writer and the commentary, and finally tounderstand the tradition of Kasida al-Nuniyya's commentaries. Il est indéniable que Comte a été influencé par Hume depuis sa jeunesse, l'influence de Comte sur Hume se manifeste de façon claire dans un article de 1819 intitulé "Séparation générale entre les opinions et les désirs" qui se trouve dans les Ecrits de jeunesse (1819-1828), et nous voyons aussi que Hume ressurgit à la fin du Système de politique positive (1851-1854), texte dans lequel Auguste Comte affirme qu'il appartient à l'école de Hume. Nous avons deux philosophies anthropologiques qui établissent (...) les fondements d'une vie sociale et d'une théorie morale ancrées dans la nature humaine, dans les désirs et les instincts incontrôlés et qui exigent une régulation par la médiation de la sociabilité et du temps. La question des passions, des penchants et des sentiments se dégage d'une problématique classique celle qui l'intégrait au sein d'un subjectivisme rationaliste, qui soumettait le corps à l'emprise de l'âme. Bu araştırmanın konusu, Ernest Harms’ın dini gelişim teorisini Tanrı tasavvuru kuramları bağlamında ele almaktır. Bu doğrultuda araştırmada, dini gelişimde Tanrı tasavvurunun önemini Harms’ın çalışması çerçevesinde incelemek amaçlanmıştır. Çalışmada bilimsel araştırma yöntemlerinden doküman analizi yöntemi uygulanmıştır. Araştırmada Harms’ın hayatı, çalışmaları ve dine bakış açısı açıklanarak değerlendirmelerde bulunulmuştur. Araştırma sonucuna göre dini gelişim teorileri arasında yer alan Harms’ın teorisi Tanrı tasavvuru bağlamında çizim yöntemiyle ele alınan orijinal çalışmalar arasında yer almaktadır. Bununla birlikte Harms, pek çok alanda eser vermekle birlikte bu teoriyi ileri (...) bir düzeyde ele almamıştır. Teorinin, çoğu dini gelişim teorileri gibi Piaget’în dini gelişim teorisi üzerine kurulu olması açısından sınırlı kaldığı söylenebilir. Tanrı tasavvuru ile ilgili araştırmaların ise Harms’ın çalışması da dâhil olmak üzere belirli din veya mezhebe mensup gruplar arasında yapıldığı; Türkiye’de kuramsal açıdan yeterli çalışma olmadığı görülmüştür. Ateizmin gerekçelendirilmesi gereken bir tutum olup olmadığı ve hangi koşulların sağlanması durumunda rasyonel bir gerekçelendirmeden bahsedilebileceği sorunu, en az teizmin gerekçelendirilmesi sorunu kadar önemlidir. Bu makalede ateizmin inançsızlık veya Tanrı inancının bulunmaması şeklinde negatif yolla tanımlanması durumunda nasıl bir gerekçelendirmenin öngörüldüğü ele alınmaktadır. Ateizm, inançsızlık olarak ele alınırsa, bu durum onun gerekçelendirmeden muaf olduğu sonucuna götürebilir mi? Ateistin “Tanrı vardır” önermesinin yanlış, “Tanrı yoktur” önermesinin doğru olduğunu gösterme amaçlı bir ispat yükümlülüğü bulunmamakta mıdır? Ateistik gerekçelendirme söz konusu olduğunda karşımıza delilin (...) yokluğu yaklaşımı ve yokluğun delili yaklaşımı olmak üzere iki farklı seçenek çıkar. Bu makalenin konusu olan delilin yokluğu yaklaşımının değerlendirilebilmesi için öncelikle “Tanrı vardır” önermesinin doğruluğuna dair yeterli delil bulunmaması durumunda bu önermenin inkârının zorunlu olup olamayacağı ele alınmıştır. Daha sonra ise yeterli delil bulunmaması durumunun negatif ateizmden pozitif ateizme geçişi meşru kılıp kılamayacağı irdelenmiştir. Makalede ateizmin gerekçelendirilebilmesinin, delilin yokluğunun yokluğun delili için yeterli görüldüğü bir savunmadan ziyade pozitif deliller ile mümkün olabileceği savunulmaktadır. Ateizm, önermesel bir tutumdan ziyade bir tür psikolojik inançsızlık hâli olarak değerlendirilirse bu durum, onun epistemik boyutunun göz ardı edilmesine neden olacaktır. Bu çalışmada ateizmin Tanrı’nın varlığına dair inançsızlık veya bir tür kayıtsızlık hâli olarak görülmesinin imkânı irdelenmekte ve bu durumun ateistik savunuya bir katkı sağlayamayacağının gösterilmesi amaçlanmaktadır. Delilci bir bakış açısından herhangi bir delil sunmadan ateizmin doğru olduğu sonucuna ulaşılması, kendi kendisine referansla tutarsız görünmektedir. (shrink)
